These Terms & Conditions ("Terms") govern the relationship between  there! travel consults & planning   ("the Agency," "we," "us," or "our") and any individual or group ("Client," "you," or "your") who engages our services to plan, book, or coordinate travel arrangements. By requesting a quote, booking travel, or otherwise engaging our services, you agree to be bound by these Terms.

1. Role of the Agency

The Agency acts solely as an intermediary between the Client and third-party travel suppliers, including but not limited to airlines, cruise lines, tour operators, hotels, transportation companies, and other travel service providers ("Suppliers"). The Agency does not own, operate, manage, or control any Supplier and is not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any Supplier, or for any injury, damage, loss, accident, delay, or irregularity that may result from their services.

2. Booking and Payment

  • All bookings are subject to availability and confirmation by the relevant Supplier(s).

  • Quoted prices are subject to change until a booking is confirmed and payment is received, due to factors such as currency fluctuations, fuel surcharges, taxes, and Supplier pricing changes.

  • Deposit amounts, final payment due dates, and accepted payment methods will be specified at the time of booking and vary by Supplier.

  • Failure to submit payment by the required due date may result in automatic cancellation of the booking by the Supplier, subject to that Supplier's cancellation policy.

  • A planning fee may apply for the Agency's advisory and booking services, as disclosed prior to engagement. Planning fees are non-refundable unless otherwise stated in writing.

3. Cancellations, Changes, and Refunds

  • Cancellation and change policies are set by individual Suppliers and vary by booking. The Client is responsible for reviewing and understanding the specific cancellation policy applicable to each component of their trip prior to booking.

  • The Agency will make reasonable efforts to assist with cancellations or changes but cannot guarantee refunds, waivers, or accommodations from Suppliers.

  • Any refund due will be processed according to the Supplier's policy and timeline, less any non-refundable planning fees or Agency service charges.

4. Travel Insurance

We strongly recommend that all Clients purchase comprehensive travel insurance, including coverage for trip cancellation, interruption, medical emergencies, and evacuation. The Agency is not liable for any losses that could have been covered by travel insurance if the Client declines to purchase a policy.

5. Travel Documents and Requirements

  • Clients are solely responsible for ensuring they possess valid passports, visas, vaccinations, and any other documentation required for their itinerary.

  • The Agency may provide general guidance on documentation requirements but is not responsible for verifying eligibility, obtaining documents, or any consequences resulting from inadequate or improper documentation, including denied boarding or entry.

  • Requirements vary by destination, nationality, and airline, and are subject to change without notice. Clients should confirm current requirements with the relevant embassy, consulate, or government authority.

6. Health, Safety, and Assumption of Risk

Travel inherently involves risk, including but not limited to illness, injury, political unrest, natural disasters, and other unforeseen events. By booking through the Agency, the Client acknowledges and accepts these risks. Clients with medical conditions, mobility limitations, or dietary restrictions should notify the Agency in advance so this information can be communicated to Suppliers, though the Agency cannot guarantee accommodation of such needs.

7. Pricing and Itinerary Changes

Itineraries, pricing, and included services are subject to change by Suppliers without notice. The Agency will make reasonable efforts to notify Clients of material changes as soon as practicable but is not liable for changes outside its control.

8. Force Majeure

The Agency is not responsible for any failure to perform its obligations, or for any loss, damage, delay, or cancellation, caused by events beyond its reasonable control, including but not limited to acts of God, weather, natural disasters, war, terrorism, civil unrest, strikes, pandemics, government actions, or Supplier insolvency.

9. Limitation of Liability

To the fullest extent permitted by law, the Agency's total liability for any claim arising from its services shall not exceed the amount of planning fees paid directly to the Agency by the Client. The Agency shall not be liable for indirect, incidental, consequential, or punitive damages of any kind.

10. Client Conduct

Clients traveling as part of a group tour agree to conduct themselves in a manner that does not disrupt the experience of other travelers or violate the policies of Suppliers. The Agency and/or tour operator reserves the right to remove a Client from a group experience for conduct deemed disruptive or unsafe, without refund.

11. Use of Website and Marketing Content

All content on the Agency's website and marketing materials, including text, images, and itineraries, is the property of the Agency unless otherwise credited, and may not be reproduced or distributed without written permission.

12. Privacy

Personal information collected during the booking process (including names, contact details, passport information, and payment details) will be used solely for the purpose of arranging and managing travel and will be shared with Suppliers only as necessary to complete bookings. The Agency will not sell Client information to third parties.

13. Dispute Resolution and Governing Law

These Terms shall be governed by the laws of the State of Arizona, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Agency's services shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona.

14. Changes to These Terms

The Agency reserves the right to update or modify these Terms at any time. Continued use of the Agency's services after changes are posted constitutes acceptance of the revised Terms.
